Brad Bowling is a skilled and creative lawyer who handles important intellectual property matters for his clients. As a trained engineer, Brad is conversant in a broad range of technologies, from vending machines to mathematical encoding for communicating with orbiting satellites. Brad knows that although the technical details of a case are important a lawsuit is first and foremost about people and their lives and work.   

Brad has managed all phases of patent infringement cases, from pre-suit investigations through trials and appeals. His experience includes post-grant investigations, including inter partes reviews in the U.S. Patent Office, a critical consideration for any modern patent infringement case. Brad has worked on dozens of such reviews for both patent owners and challengers, and Section 337 investigations in the U.S. International Trade Commission as another effective option for enforcement patent rights.   

As a former engineer and software developer, Brad knows how engineers think, work, and interact with other members of their organization. His knowledge of the tools of development along with traditional, Agile, and Agile-ish development practices helps to identify crucial technical information. Other important considerations are engineers’ and organization’s interactions with standards-setting bodies. Brad has extensive experience with the complex interaction between intellectual property rights and standards setting organizations, such as MPEG, IEEE, and 3GPP.   

Brad’s background also involves patent prosecution before the U.S. Patent office and patent portfolio development.  He has helped clients grow from start-ups with no patent protection to owning portfolios that helped to secure investor funding. Brad brings this experience to disputes and licensing negotiations. 

Brad is a dogged advocate and trusted counselor for his clients.

  • Obtained an International Trade Commission exclusion of competitors’ products on behalf of a telecommunications and on-demand media company. 
  • Won summary judgment in a copyright case for an online brokerage.  
  • Invalidated all asserted claims in an inter partes review on behalf of a telecommunications and on-demand media company. 
  • Successfully prosecuted patent infringement claims relating to streaming video and network access technologies in a competitor case in multiple district court.  
  • Won summary judgment of invalidity at claim construction phase on behalf of a telecommunications and on-demand media company. 
  • Successfully defended patent infringement claims against a cell phone maker.
